The rules for ordering from us

Terms of Service

These terms apply every time you order from Magies Vol, whether you order through our website, by phone, by WhatsApp or by email. Please read them before you place an order, because placing an order means you accept them.

Placing an order

  • Orders must be booked and paid in full at least 48 hours before delivery or collection
  • Functions of more than 25 people need at least 7 days notice
  • Your order is only confirmed once payment reflects in full in our account
  • Until payment reflects, we hold nothing and your date is not reserved
  • We may decline an order, for example if we are fully booked for that date or cannot meet a dietary requirement safely

Quotes are valid for 7 days unless we say otherwise on the quote itself.

Prices and payment

  • All prices are in South African Rand and include VAT where applicable
  • Delivery is quoted separately and depends on distance
  • Online payments are powered by Stitch Express. We also accept EFT
  • Approved account customers may pay against a purchase order
  • Prices on the website and in our menu PDF may change. The price that applies is the one on your quote or invoice

If a price is obviously wrong because of an error on our side, we will tell you before we take payment and you may cancel that order for a full refund.

Platter sizes

Every platter is made up to serve up to 8 people. Half platters are charged at 80 percent of the full platter price, because the packaging, preparation time and minimum ingredient quantities do not halve.

Serving numbers are a guide based on normal appetites at a normal event. If the platter is the only food at a long function, order accordingly, and ask us if you are not sure.

Changes and cancellations

Changes to a confirmed order must reach us at least 48 hours before delivery or collection. After that point we have bought the ingredients and started preparation, so changes may not be possible.

Cancellations are dealt with in our Refunds and Returns Policy, which forms part of these terms.

Allergies and dietary requirements

Please tell us about any allergy, intolerance or dietary requirement when you place your order, not on the day. We cannot safely change a platter once it is made.

Our kitchen handles nuts, dairy, gluten, eggs, fish, shellfish, soya and sesame. We take care to avoid cross contamination, but we prepare all our food in one kitchen and we cannot guarantee that any item is completely free of a given allergen.

If an allergy is severe or life threatening, please tell us plainly so that we can advise you honestly about whether we can cater for you. We would rather turn an order away than take a risk with someone's health.

You are responsible for telling your own guests what is in the food we supply. We will give you an ingredient list for anything we make if you ask for one.

Delivery and collection

Delivery areas, fees, timing and collection arrangements are set out in our Shipping and Delivery Policy, which forms part of these terms.

Food safety once it reaches you

  • Fresh platters are made for the date you chose and should be eaten on that day
  • Refrigerate anything you are not serving immediately, and keep it below 5 degrees Celsius
  • Do not leave platters standing in the sun or in a warm room for more than two hours
  • Frozen meals must go into a freezer as soon as they reach you, and must not be refrozen once thawed

Once your order has been handed over to you or your representative, responsibility for storing and serving it safely passes to you.

Ordering through Uber Eats

Where you order through Uber Eats or any other third party platform, that platform's own terms govern your order, their payment process and their delivery. We remain responsible for the food we make. Refunds and complaints about a platform order usually have to be raised through that platform, though you are welcome to contact us as well and we will help where we can.

Your responsibilities

  • Give us accurate contact and address details
  • Make sure someone is available to receive the order at the agreed time
  • Tell us about allergies and dietary requirements before you pay
  • Do not resell our food as your own without a written agreement with us

Our brand and content

The Magies Vol name, logo, menus, recipes, photographs and website content belong to us. You may share our content on social media with credit, but you may not copy, resell or use it commercially without our written permission.

Our liability

We take responsibility for the food we supply. Nothing in these terms limits or excludes any right you have under the Consumer Protection Act 68 of 2008, including your right to safe, good quality goods and your rights in respect of harm caused by unsafe goods.

Beyond that, and to the extent the law allows, we are not liable for indirect or consequential loss, such as loss of profit or the cost of an event being disrupted. Where we are liable, our liability is limited to the value of the order concerned.

We are not liable for a failure to deliver caused by something genuinely outside our control, including load shedding beyond scheduled hours, extreme weather, road closures, civil unrest or a supplier failure we could not reasonably have foreseen. In that case we will contact you as soon as we know, and refund you in full if we cannot supply.

Complaints and disputes

Please raise any problem with us first, on 066 408 8267 or at hello@magiesvol.co.za. Most things are quickly sorted out.

If we cannot resolve it between us, you may refer the matter to the Consumer Goods and Services Ombud at cgso.org.za, or to the National Consumer Commission.

General

  • These terms are governed by the law of the Republic of South Africa
  • If any part of these terms is found to be unenforceable, the rest still applies
  • We may update these terms. The version that applies to your order is the one published when you placed it
  • Our Privacy Policy, Refunds and Returns Policy and Shipping and Delivery Policy all form part of these terms
